This policy is understood, in any case, without prejudice to the provisions of the corresponding Legal Notice.

By the mere fact of visiting the Website, the company does not record any personal data in any database; however, certain non-personal information is collected on the servers that provide hosting services to THE FOUNDATION. This information includes data relating to the IP address from which the website is accessed.

The user is responsible for providing all data correctly. THE FOUNDATION accepts no responsibility for service failures resulting from incorrect or false data.

It is necessary to provide personal data considered obligatory in some contact forms. Also to accept the corresponding Privacy Policy and the corresponding Legal Notice.

RESPONSIBLE FOR THE DATA PROCESSING

The information that may be requested from users of this website through contact forms, the data included in possible comments on the corporate pages of social networks linked or not linked, but is responsibility of THE FOUNDATION, the personal data that the user enters in the sections provided, or those provided by other means or channels of communication provided (for example, email or private sections) are under the responsibility of THE FOUNDATION. THE FOUNDATION will use the data provided by the USER in the consultation forms or those provided by e-mail or those included through the other channels exclusively for the processing of the consultation requested and the specific management requested, if applicable.

If the USER enters their data in any form relating to the “contact” section or sends us an email, the Holder informs us that they will form part of a database owned by the entity itself. The purpose of this record is the specific management that the interested party has requested.

If the USER consents by ticking the corresponding boxes on the registration forms to receive the newsletter from THE FOUNDATION. THE FOUNDATION hereby informs that the data will form part of a database owned by THE FOUNDATION, the purpose of which is to send out THE FOUNDATION’s newsletter.

DATA PROCESSING LEGITIMATION

The treatment for the data processing is based on the execution of a subscribed contract between you and the FOUNDATION for the provision of the requested service. The consent is granted through the forms available on the website. 

RETENTION PERIOD FOR PERSONAL DATA

The provided personal data will be kept in the necessary period to manage your consultation, suggestion, complaint, or claim. Also for the requested service provision or the development of the contractual relationship established between you and the FOUNDATION.

Once it is ended, the personal data will be kept in the corresponding period to comply with the legal obligation during the period that a judge or tribunal may require.

In the case of subscriptions to electronic newsletters, the data will be processed for as long as you do not revoke your consent or object to the processing.

The sending of CVs will be processed for two years unless you revoke your consent or object to the processing.

The official profiles in the social networks linked to this Website have been created to better publish our activity and create an alternative channel with the interested persons on our entity and the services we offer.

USERS RIGHTS

The data subject may, in any case, exercise the rights to which he/she is entitled, in accordance by the RGPD (General Data Protection Regulation), which are:

USER COMPROMISES 

The USER guarantees that it is over 14 years old and that the provided information is exact and true.

The USER is compromised to inform the FOUNDATION of any modification that the provided information suffers through the email address: “atencion@biosalud.org”. Being identified as USER of the WEBSITE and concretely the information that must be modified. 

Likewise, the USER is committed to keep the keys and identification codes and inform the FOUNDATION in case of loss, subtraction, or unauthorized access.

If the communication isn´t produced, the FOUNDATION will be absolved of any responsibility derived from the misuse of not authorized third parties of such passwords and identification codes.

THIRD PARTIES DATA PROVIDED BY THE USER

If the USER facilitates the third parties´ data with any finality, guarantees to have informed previously the affected and have obtained the consent for the data communication to the FOUNDATION.

The FOUNDATION will contrast the affected consents through a first email with no commercial content asking for the consent verification granted in name by the USER.

Social networks

The FOUNDATION maintains several pages or profiles in the social networks linked to the present Website. The same will not be responsible for the publication by third parties mentioned in the social networks. The use and data treatment done in the mentioned social networks will be submitted to general conditions or different particular to the current. It is recommended to read it carefully and have conscience and respect for it.

Concerning Facebook, when a user is fan of our page through the button “Like”, authorizes its data are used just through the mentioned social networks with management purposes we use it unically with a fan page purposes and the communications that we maintain bidirectional with our followers with the chat, messages, or other communication media that allow Facebook now and in the future. However, the processing will be subjected to privacy policies of these social networks and that the USER can consult in the following link: “https://www.facebook.com/policy.php”. 

We would also like to inform you that when a user becomes a fan, the news we publish will also appear on their wall. If they make comments on our wall, both their comments and the name of their profile and, where appropriate, the photograph they have on it, will be accessible to other fans.

In the case of emails sent by the FOUNDATION inside the contractual relationship united to the same, we inform you that the provided information in the mentioned email or attached files can be confidential. Accessing or disclosing the content of an email is a criminal offense under Article 197 of the Penal Code.

If you are not the intended recipient, we inform you that any use, distribution, disclosure, or reproduction of this information is prohibited without the express permission or authorisation of the legitimate recipient, by current legislation.

Please inform us immediately by this same means or by telephone and proceed to its destruction.

E-mail does not guarantee the confidentiality of the messages transmitted, nor their integrity or correct reception.

THE FOUNDATION has adopted the necessary technical and organisational measures to guarantee the security of personal data and prevent its alteration, loss, processing, or unauthorised access, taking into account the state of technology, the nature of the data stored, and the risks to which it is exposed, whether from human action or the natural physical environment.

However, the USER must be aware that security measures on the Internet are not impregnable.
